Her wife handed rice flour to her husband who was preparing to go to work at dawn.
Later, when her husband returned home complaining of abdominal pain, her wife handed him white porridge this time.
Her husband’s stomach pain continued 안전놀이터even after he ate the porridge, and he was eventually taken to the emergency room at the hospital, where he was treated and returned home.
Then her wife handed her some cold water and encouraged her to drink and sleep.
After drinking it, her husband died.
A lethal dose of nicotine was detected in the deceased husband’s blood.
A large amount of nicotine was detected in the body of her husband, who had quit smoking 8 years ago.
Prosecutors charged her with her murder, saying that her wife caused her husband to die by handing her nicotine-laced food. In both the first and second trials, her wife was sentenced to 30 years in prison.
Unlike the first trial, which found that rice flour, white porridge, and cold water that her wife gave her all contained nicotine, the second trial judged that only the last cold water that her wife gave her had nicotine in it, but admitted that her wife murdered her husband. it was the same
However, the Supreme Court judged differently.
The Supreme Court said, “The results of the autopsy and the opinion are only meaningful in that the victim’s cause of death was acute nicotine poisoning and that the victim had an overdose of oral nicotine after going to the emergency room.”
She added that after the wife gave her husband her cold water, she added that it is questionable whether it can completely rule out the possibility that her husband consumed nicotine for other undisclosed circumstances.
It is true that nicotine was present in the body of the deceased husband, but it cannot be concluded that it was because of the cold water his wife gave him.
The Supreme Court also pointed out that “at the time, more than 2/3 of the water was left in the water cup,” and that “it can be seen that the victim barely drank water and left it.”
Judgment on the motive for the crime has also changed.
The lower court acknowledged the possibility that the wife, who had an internal affair with another man, committed her crime aiming at her husband’s property, such as insurance money, but the Supreme Court said that it was questionable whether that part served as a sufficient motive.
Following the Supreme Court’s dismissal and remand, the case was tried again in the Suwon High Court.
